The state of DACA today

     On July 16, 2021, U.S. District Court Judge Andrew Hanen, ruled DACA unlawlful and called on the Biden administration to cease granting new requests. According to the National Immigration Law Center, the court stated that the desicion was not a termination of DACA, and that those who already benefited from the program could continue to renew, however the Department of Homeland Security prohibited the approval of any new requests. 


     Immediately following the court’s decision, President Joe Biden released a statement calling the court’s ruling “deeply disappointing”. 


     “I have repeatedly called on Congress to pass the American Dream and Promise Act, and I now renew that call with the greatest urgency. It is my fervent hope that through reconciliation or other means, Congress will finally provide security to all Dreamers, who have lived too long in fear,” read the official statement.


     On September 10, 2021, the Biden administration appealed Judge Hanen’s decision.


     Currently, U.S. Citizenship and Immigration Services is accepting first-time requests for consideration of DACA and accepting DACA renewal requests.
